Important: By accessing or using the FloodGuard application, dashboard, or API, you agree to these Terms & Conditions. If you are using FloodGuard under a contract with your organisation or government body, the terms of that contract take precedence over these general terms where they conflict.
1. Definitions
- "Jenix Technology" / "we" / "us" — the developer and operator of FloodGuard
- "FloodGuard" — the IoT flood monitoring system including hardware controllers, cloud backend, Android application, and web dashboard
- "Client" / "Organisation" — the government body, department, or company that has contracted FloodGuard for deployment
- "User" — an individual authorised by a Client to access the FloodGuard system
- "System" — collectively, the hardware devices, firmware, cloud servers, and software applications
2. Acceptance of Terms
These Terms & Conditions govern your use of the FloodGuard system. By logging into the application, installing the Android app, or accessing the web dashboard, you confirm that:
- You are an authorised user appointed by a Client organisation
- You have read and agree to these terms and our Privacy Policy
- You are at least 18 years of age
3. Purpose of the System
FloodGuard is an operational safety and monitoring tool designed to assist government authorities, municipal corporations, railways, and infrastructure managers in monitoring water levels at underpasses, railway underbridges (RUBs), and low-lying road stretches.
The system provides:
- Real-time water level data from IoT sensors
- Configurable alert and danger threshold notifications
- On-site alarms (siren, beacon, voice announcement)
- Remote alarm management via mobile app and dashboard
- Audit trails and compliance reports
- Push notifications via Firebase Cloud Messaging (FCM)
4. User Accounts and Access
4.1 Account Creation
User accounts are created exclusively by authorised administrators within a Client organisation. Self-registration is not available. Each user is responsible for:
- Keeping their login credentials confidential
- Not sharing their account with any other person
- Notifying their administrator immediately if they suspect unauthorised access
4.2 Roles and Permissions
The system uses role-based access control. Actions available to you depend on the role assigned by your administrator. Attempting to access system functions beyond your assigned role is prohibited.
4.3 Account Termination
Administrators may deactivate your account at any time. Jenix Technology may suspend or terminate access to the system if these terms are breached.
5. Push Notifications (FCM)
When you install the FloodGuard Android app and grant notification permission:
- A Firebase Cloud Messaging (FCM) token is generated by Google and stored on FloodGuard servers
- This token is used solely to send you flood alerts relevant to your assigned monitoring locations
- You may withdraw notification permission at any time via Android device settings
- Push notifications are operational alerts — not marketing messages
By granting notification permission, you consent to receiving flood alert push notifications as described in our Privacy Policy.
6. Permitted Use
You may use FloodGuard solely for its intended operational purpose — monitoring water levels and managing flood alerts at sites operated by your Client organisation. You must not:
- Attempt to access data belonging to other organisations or locations not assigned to you
- Reverse-engineer, decompile, or tamper with the hardware firmware or software
- Use the system to transmit malicious code, spam, or illegal content
- Share API keys, device credentials, or authentication tokens with unauthorised persons
- Use automated scripts or bots to access the dashboard or API without written permission from Jenix Technology
- Attempt to overload, attack, or disrupt the cloud infrastructure
7. Alarm and Alert Responsibilities
FloodGuard provides automated alerts as a decision-support tool. It does not replace human judgement, on-site inspection, or established emergency response procedures. Clients and users acknowledge that:
- Alert thresholds must be configured appropriately by a qualified technical administrator
- On-site personnel must be trained in emergency response procedures independently of this system
- Jenix Technology is not responsible for decisions made in response to (or in the absence of) system alerts
- Network outages, sensor faults, or power failures may result in delayed or missed alerts; the system should not be the sole safeguard against flooding incidents
8. Hardware and Firmware
- Hardware devices remain the property of the Client organisation after purchase and installation
- Firmware updates may be pushed over-the-air (OTA) to deployed devices to fix bugs or improve performance
- Clients must not modify, tamper with, or unauthorisedly flash firmware on FloodGuard hardware
- Hardware warranty and support terms are governed by the separate purchase/service agreement between the Client and Jenix Technology
9. Data and Audit Trail
All user actions within the FloodGuard system (alarm mute, config changes, forced clears, user management) are logged in an audit trail. This trail is accessible to authorised administrators and may be used for:
- Operational review and incident investigation
- Government compliance and reporting requirements
- Dispute resolution between parties
By using the system, users consent to this logging as part of normal operations.
10. Availability and Uptime
Jenix Technology will use reasonable efforts to maintain system availability. However, we do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. Unplanned outages may occur due to infrastructure dependencies (cloud providers, MQTT broker, network). Clients are advised to maintain independent on-site alarm capabilities.
11. Intellectual Property
All intellectual property in the FloodGuard system — including software, firmware, algorithms, dashboard design, and documentation — belongs to Jenix Technology. No licence is granted to copy, distribute, or commercialise any part of the system outside the scope of the service agreement.
12. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- Jenix Technology is not liable for any loss of life, injury, property damage, or financial loss arising from flooding incidents, whether or not the FloodGuard system was operational at the time
- Our aggregate liability for any claim under these terms is limited to the amount paid by the Client for the service in the three months preceding the claim
- We are not liable for indirect, consequential, incidental, or punitive damages
These limitations do not exclude liability for gross negligence or wilful misconduct on the part of Jenix Technology.
13. Governing Law and Disputes
These Terms & Conditions are governed by the laws of India. Any disputes arising from use of the FloodGuard system shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of India.
14. Changes to These Terms
We may update these Terms & Conditions to reflect product changes or legal requirements. The latest version will always be available at floodguard.jenix.in/terms.html. Continued use after changes constitutes acceptance of the updated terms.
